These Customer Terms ("Terms") are a legal agreement between you and Propera Pvt Ltd, a company incorporated in the Republic of Maldives that operates the Eveyla platform ("Eveyla", "we", "us", "our"). They apply whenever you visit Eveyla, browse a shop, place an order, leave a review, or otherwise use the platform as a customer.
By using Eveyla or placing an order, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy, which is part of this agreement. If you do not agree, please do not use Eveyla.
Please read section 10 (Food, ingredients, and allergens), section 12 (Cancellations, refunds, and problems), and section 22 (Our liability) carefully. They affect your legal rights.
In these Terms:
Eveyla is an online storefront and ordering tool. It lets local shops, restaurants, and home kitchens show their products and take orders, and it gives you a way to browse them and place an order in one place.
Eveyla provides the technology only. We are not the seller. We do not own, make, store, prepare, package, inspect, test, or deliver any Product. We do not set prices. We do not collect or hold your payment for an Order.
When you place an Order, your contract to buy is directly between you and the Shop. Eveyla is not a party to that contract. We simply pass your Order to the Shop and show you its status. We are also not a courier, a payment service, a food business, or a guarantor of any Shop.
You must be at least 18 years old and able to enter into a binding contract under the laws of the Maldives to place an Order on Eveyla, or you must have the consent of a parent or legal guardian. If you are under 18 and order with that consent, your parent or guardian is responsible for your Order and for your use of Eveyla, as if they had placed the Order themselves.
If you place an Order for a business or other organisation, you confirm that you are authorised to act for it, and these Terms bind both you and that organisation.
By placing an Order you confirm that you meet these requirements. Eveyla is intended for use in the Republic of Maldives.
You do not need to create an account to place an Order as a customer. To make ordering easier, Eveyla saves some information in your browser on your device, such as your cart, the name, phone number, and address you last used, and links to your recent Orders. This information stays on your device, is not an account, and you can clear it at any time through your browser. More detail is in our Privacy Policy.
If you run a Shop, separate terms apply to you in addition to these Terms. See the Shop Terms.
When you submit an Order, you are making an offer to buy the selected Products from the Shop on the terms shown at checkout.
A contract between you and the Shop is formed only when the Shop accepts or confirms your Order, or begins preparing it. Until then, the Shop may decline your Order for any reason, including that a Product is sold out, the delivery area is not served, the Shop is closed or at capacity, the Order cannot be fulfilled, or the Shop suspects fraud or error.
Order status labels shown on Eveyla (for example received, preparing, on the way, delivered) are provided by the Shop for your convenience and are estimates only. They do not change who is responsible for your Order, which is always the Shop.
The Shop may need to substitute, adjust, or partially fulfil an Order. Any such change, and any agreement about it, is a matter between you and the Shop.
Order notes. Any note or special instruction you add to an Order is a request only. The Shop will try to follow it but is not guaranteed to do so. Do not use an order note as your only way of telling a Shop about an allergy or other serious requirement. Contact the Shop directly, as explained in section 10.
Scheduled and pre-orders. Some Shops let you order for a later date or time. The date and time you choose is a request, and the Shop confirms whether it can meet it. Scheduled times are estimates given by the Shop, not guarantees by Eveyla.
The Shop's own policies. A Shop may have its own policies or terms for its sales, for example on cancellations or refunds. Those apply between you and the Shop, so long as they are lawful. Where they conflict with these Terms about your use of the platform itself, these Terms prevail.
Fraud and abuse protection. Eveyla may block, limit, or cancel Orders that appear to be fraudulent, automated, abusive, or placed in bad faith, and may apply technical limits, such as rate limits, to protect Shops and the platform.
Prices, delivery fees, ferry or surcharge amounts, minimum order values, delivery areas, available islands, and operating hours are all set and controlled by the Shop, not by Eveyla. They are shown to you before you confirm an Order, and your Order total is calculated at checkout.
Prices are shown in Maldivian Rufiyaa (MVR) unless stated otherwise. Any tax (including Goods and Services Tax, where it applies) is the responsibility of the Shop and is reflected in the Shop's prices unless the Shop states otherwise.
The price that applies to your Order is the price shown at checkout when you place it. Prices can change over time, and prices on Eveyla may differ from the prices a Shop charges in person or on other channels.
Pricing or listing errors. Listings are created by Shops and may occasionally contain mistakes, including in price, description, image, or availability. Eveyla does not warrant that any listing is accurate, complete, or current. If a Shop identifies an error in your Order, it may cancel or correct the Order and contact you. Eveyla is not responsible for Shop listing errors.
Promotions and discount codes. A Shop may offer promotions or discount codes. These are created, funded, and honoured by the Shop, are subject to any conditions the Shop sets, and may be changed or withdrawn by the Shop at any time. Discount codes have no cash value and cannot be exchanged for cash. Any question about whether a code applied correctly or a discount was calculated correctly is a matter between you and the Shop.
You pay the Shop directly. Depending on what the Shop offers, you pay by cash on delivery or by bank transfer. There is no card payment on Eveyla, so we never collect or store card or banking credentials.
Eveyla never collects, holds, processes, or refunds your Order payment. We are not a payment service, money transfer service, or escrow. If you pay by bank transfer, you may upload a transfer receipt so the Shop can confirm it. The Shop, not Eveyla, decides whether payment has been received and marks the Order as paid.
Any dispute about whether a payment was made, received, or correct (for example a failed, duplicated, reversed, or incorrect bank transfer) is between you, the Shop, and your bank. Eveyla can only show the receipt you uploaded and cannot verify, reverse, or recover any transfer.
Fulfilment is arranged and carried out by the Shop, using its own staff or delivery arrangements, including any ferry or boat handoff where the Shop offers island delivery. Pickup details, delivery details, departure island, ferry information, and any surcharge are provided by the Shop.
Delivery and preparation times shown on Eveyla are estimates given by the Shop and are not guaranteed. Eveyla does not control, supervise, or take responsibility for delivery, pickup, ferry handoff, timing, the condition of Products on arrival, or anyone who delivers an Order.
Deliveries in the Maldives can be affected by weather, sea conditions, ferry and boat schedules, and other events outside the Shop's control. These can delay an Order or make a delivery area temporarily unavailable.
You are responsible for giving accurate delivery information and for being reachable and available to receive your Order. A delivery may fail if, for example, no one is available to receive it, you cannot be reached on the phone number you gave, the address is wrong or cannot be accessed, or there is no safe way to hand over the Order. In these cases the Shop may treat the Order as failed under its own policy, and any refund is at the Shop's discretion. Failed deliveries are a matter between you and the Shop.
Risk in and ownership of the Products pass to you when you, or someone you authorise, receive them. Please check your Order promptly when you receive it. If something is missing, wrong, damaged, or not as expected, tell the Shop as soon as you can, using the Call, WhatsApp, or Viber options on your Order or tracking page. Raising a problem promptly gives the Shop the best chance to help, and a Shop's ability or willingness to resolve an issue may depend on how soon you report it.
This section is important, especially because many Shops are home kitchens and small food businesses.
Eveyla does not prepare, cook, handle, store, inspect, test, certify, or supervise any food or other Product. We do not verify any Shop's hygiene, food safety practices, licences, ingredients, sourcing, preparation, or claims. We make no representation or warranty about the safety, quality, freshness, hygiene, nutritional content, ingredients, or fitness for any purpose of any Product.
The Shop alone is responsible for the food and goods it sells, including food safety and hygiene, accurate ingredient and allergen information, correct labelling, and compliance with all applicable laws and licences.
If you have a food allergy, intolerance, dietary requirement, religious requirement, medical condition, or any sensitivity, you must contact the Shop directly and confirm that a Product is suitable for you before you order. Do not rely on Eveyla listings, item names, descriptions, photos, or category labels for this purpose. Listings may be incomplete or inaccurate, and the same dish can change between batches. If you are in any doubt, do not order the Product.
To the fullest extent allowed by law, Eveyla is not liable for any allergic reaction, illness, injury, or other harm arising from any Product, its ingredients, its preparation, or any information or omission in a listing.
Some goods are restricted, regulated, or prohibited under the laws of the Republic of Maldives. You are responsible for ensuring that anything you order, receive, possess, or consume is lawful for you under Maldivian law.
Eveyla does not verify the legality of Products and is not responsible for any Shop offering, or any customer ordering, an item that is restricted or prohibited. You agree not to use Eveyla to buy anything that is unlawful for you to buy or possess.
Because your contract is with the Shop, every cancellation, change, refund, replacement, missing or wrong item, late delivery, quality issue, or other complaint about an Order is handled by the Shop, under the Shop's own policies and applicable Maldivian consumer law.
If you need to cancel or change an Order, contact the Shop as soon as possible. A Shop is more likely to be able to cancel before it accepts your Order or starts preparing it. Once preparation or delivery has started, cancellation and any refund are at the Shop's discretion and its own policies.
Each Shop sets its own cancellation and refund approach. Refunds, where offered, are made by the Shop directly, since the Shop received your payment. Eveyla does not issue refunds and cannot do so, because we never hold your money.
To raise a problem, contact the Shop using the Call, WhatsApp, or Viber options on your Order or tracking page. Eveyla is not a party to the sale and is not responsible for Products, delivery, cancellations, or refunds. As a courtesy, we may try to help you reach a Shop, but we are not obliged to resolve disputes and cannot decide them.
After you order, Eveyla may give you a link to track your Order's status. Anyone who has this link can view that Order's status and details, so treat the link as private and share it only with people you trust. You are responsible for keeping your tracking link secure.
By placing an Order, you agree that the Shop and Eveyla may contact you about that Order, including by phone call, SMS, WhatsApp, Viber, or other messaging, using the contact details you provide. These are service messages about your Order, not marketing.
If you choose to contact a Shop, or to send your Order or a message, through WhatsApp or Viber, that conversation takes place inside those apps and is governed by their own terms and privacy policies. Eveyla does not control those apps.
After an Order is delivered, you may leave one rating and an optional written comment for that Order. Reviews are shown publicly on the Shop's page.
When you submit a review, you confirm that it is your honest experience and is truthful and fair, and you grant Eveyla a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, and distribute it in connection with the platform. You must not post anything that is false, misleading, unlawful, defamatory, abusive, hateful, obscene, a violation of someone's privacy, or that infringes anyone's rights, and you must not post content that is not your own genuine experience.
We may, but are not obliged to, moderate, decline, edit for length, or remove any review, including reviews that break these rules. You remain responsible for what you post.
When using Eveyla, you agree that you will not:
We may suspend or block your access to Eveyla if we reasonably believe you have broken these rules. We may also investigate suspected breaches and report unlawful activity to the relevant authorities.
The Eveyla platform, including its software, design, layout, text, graphics, and the Eveyla name and logo, is owned by Propera Pvt Ltd or its licensors and is protected by law. You receive a limited, personal, non-exclusive, non-transferable, revocable right to use the platform to browse and place Orders. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from any part of the platform, except as the law allows.
A Shop's own name, logo, listings, and images belong to the Shop or its licensors, not to Eveyla. Nothing in these Terms gives you any right to use Eveyla's or any Shop's intellectual property beyond normal use of the platform.
Eveyla relies on and links to services we do not control, including WhatsApp and Viber for messaging, your bank or its app for transfers, and analytics providers. Your use of those services is governed by their own terms and privacy policies. Eveyla is not responsible for third-party services, their availability, or their conduct.
How we handle your information is explained in our Privacy Policy, which forms part of these Terms. When you place an Order, the Shop also receives the information it needs to fulfil and deliver your Order (such as your name, phone number, address, island, Order details, and any note), and the Shop is responsible for how it handles that information.
Eveyla is provided on an "as is" and "as available" basis. We do not promise that the platform will always be available, uninterrupted, secure, or error-free, and we may suspend, withdraw, change, or limit all or part of the platform at any time, including for maintenance or for operational, legal, or security reasons. Some features may be labelled as beta or may change.
To the fullest extent allowed by law, Eveyla disclaims all warranties, conditions, and representations not expressly stated in these Terms, whether express or implied, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement.
Without limiting the above, Eveyla does not warrant or take responsibility for: the existence, conduct, honesty, or solvency of any Shop; the safety, quality, legality, or accuracy of any Product or listing; whether a Shop will accept, prepare, fulfil, or deliver an Order; the timing or condition of any delivery; whether any payment is made or received; or the truth of any review. Your dealings with any Shop are solely between you and that Shop.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under the laws of the Maldives, including liability for death or personal injury caused by our negligence or for fraud.
Subject to that, and to the fullest extent allowed by law:
Your remedies for any problem with an Order are against the Shop, not against Eveyla.
You agree to indemnify and hold harmless Propera Pvt Ltd, and its directors, officers, employees, and contractors, from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the platform, your violation of any law, or your infringement of any third party's rights.
You may stop using Eveyla at any time. We may suspend, restrict, or terminate your access to the platform at any time, with or without notice, if we reasonably believe you have breached these Terms, used the platform unlawfully or fraudulently, or created a risk to Eveyla, a Shop, or other users. Sections that by their nature should survive (including sections 10, 11, 15, 17, 21, 22, 23, and 25) continue to apply after your use ends.
These Terms, and any dispute or claim arising out of or in connection with them, the platform, or an Order (including non-contractual disputes), are governed by the laws of the Republic of Maldives.
If you have a concern, please contact us first at hello@propera.io so we can try to resolve it informally. If a dispute cannot be resolved, it is subject to the exclusive jurisdiction of the courts of the Republic of Maldives. Any dispute about an Order itself is between you and the Shop.
We may update these Terms from time to time. When we do, we will change the "Last updated" date above and post the updated Terms on the platform. Your continued use of Eveyla after a change means you accept the updated Terms. If you do not agree to a change, please stop using Eveyla.
